General terms and conditions

1. SCOPE OF APPLICATION
The following contractual terms and conditions apply to all services in connection with transport services of all kinds provided by Philipp Eichenberger GmbH. A contract is concluded when it has been confirmed by Philipp Eichenberger GmbH, the customer accepts or confirms an offer in writing or verbally. By placing an order, the customer (also referred to as the client) declares his agreement with all the points mentioned in these terms and conditions. All our services are subject to these terms and conditions in their entirety, unless they have been amended or supplemented by written agreements.

2. OFFERS
Our quotations are limited in time according to the information provided, they are confidential and may only be made available for inspection to those people who processing  the quotations.
The prices in our quotations are binding and are understood to be payable by bank/postal transfer. In the case of lump-sum agreements, the price applies to the agreed order time. Unless otherwise agreed in writing, all prices are quoted in Swiss francs and include statutory VAT (currently 8.1%).

3. TERMS OF PAYMENT
Unless otherwise agreed in writing, the total costs are due for payment in advance at least 48 hours before the start of the service.

4. CANCELLATION OF CONTRACT
Cancellations are only valid if they are made in writing. This requires a corresponding confirmation from Philipp Eichenberger GmbH to the customer.
Cancellations will be charged as follows:
x Up to 48 hours before the start of the order: no charge
x 48 to 24 hours before the start of the order: 50% of the cost
x Less than 24 hours before the start of the order or no show: 100% of the costs

5. TRANSPORTATION
The chauffeurs of Philipp Eichenberger GmbH are in possession of a valid driver's license for passenger transport. There is no obligation to provide transportation. For the safety of our customers, we comply with the legal requirements of the Working and Rest Time Regulations (ARV). The maximum driving time of 9 hours and the maximum working and presence time of 13 (only in exceptional cases 15) hours per working day must not be exceeded.
It is not permitted to bring food and drink. Pets are not allowed. Smoking is absolutely prohibited in the vehicle. Passengers must comply with the driver's instructions. Seatbelts must be worn in the vehicle; failure to do so will result in no compensation being paid. If passengers act contrary to the driver's instructions or if they represent a safety hazard under the Road Traffic Act, Philipp Eichenberger GmbH or its driver is entitled to exclude them from the transport. In this case, the full price including all additional and special services will be charged. Philipp Eichenberger GmbH is released from its obligation to perform if a driving ban is imposed by law due to ozone or smog alerts, etc. or in the event of force majeure (snow, black ice, storms, etc.).

6. DELAYS
Additional costs due to delays shall be borne by the customer, unless the delays are due to the fault of Philipp Eichenberger GmbH.

7. DATA PROTECTION
Philipp Eichenberger GmbH guarantees that all data will be treated confidentially and will not be passed on to third parties.

8. LIABILITY OF THE CUSTOMER
Costs arising from damage to the vehicles and their interiors, such as excessive soiling of the seats, carpets, side and roof panels, as well as improper operation of the facilities by passengers are to be borne by the passengers. Recognizable damage and claims must be reported immediately after the end of the trip.

9. LIABILITY OF THE COMPANY
No liability is accepted for any damage or vehicle breakdown unless caused by intent or gross negligence on the part of Philipp Eichenberger GmbH.

10. PLACE OF PERFORMANCE AND JURISDICTION
Any disputes shall be governed exclusively by Swiss law. The place of jurisdiction shall be Tafers.
